Our client was a 22-year-old part-time window clerk for the United States Postal Service. She was chased into Linden Boulevard by her boyfriend, who was carrying a club. The defendant driver claimed that he was driving within the speed limit as our client “darted out” into the path of his vehicle. We claimed that she was in the roadway for a sufficient period of time to enable the defendant driver to stop his car, or otherwise avoid hitting our client. As a result of the impact, she was knocked unconscious and was unresponsive at the scene. Her heart stopped while in the ambulance on route to the hospital. EMS workers were able to restore her pulse and she was admitted to Brookdale Hospital. She remained comatose until her death three days later. She was survived by her infant children, ages five and seven. At trial in Brooklyn Supreme Court, the jury found that our client was 10% responsible for the accident and the defendant driver was 90% responsible.
