Our client, a 19-year-old single woman, was in the latter stages of her first pregnancy when she detected a lack of fetal movement. Her treating ob-gyn, the defendant, informed her that the fetus was “asleep.” Several weeks later, she stopped feeling fetal movement but did not inform her doctor since she falsely believed the fetus was sleeping. When she finally presented to the hospital, fetal distress was noted, and an emergency c-section was performed. The deprivation of oxygen caused the infant to suffer brain damage and cerebral palsy.
