Our client was a 25-year-old carpenter working on the roof of a commercial building in Suffolk County. The surface of the roof was unfinished plywood. On the accident date, the start of work was delayed because frost was noticed on the roof surface. Once the “all clear” was given to begin work, our client accessed the roof. After only a few steps, he slipped, lost his balance, slid 20-30 feet, and then fell about 20 feet off of the roof. He had asked his foreman for a safety device, but none was provided. The general contractor at the site had recently bought new harnesses for workers, but there was no place on the roof to tie off. As a result of the fall, our client suffered a calcaneus (heel) fracture that required surgery, a dislocated right shoulder, and a pneumothorax (punctured lung).
