Our client, a 21-year-old permanent resident of Barbados, was visiting relatives in Brooklyn when she developed a sudden onset of back pain and paralysis. She was taken to a Brooklyn hospital where she was diagnosed with a thoracic spinal mass. However, the surgery to remove the mass was not performed in a timely manner. We claimed that the delay in performing that surgery to remove the mass deprived her of the chance for a better recovery. Defendant claimed that by the time she presented to the hospital, no treatment could have prevented her permanent paraplegia. The case settled before trial.
