Our client was a Spanish speaking woman who presented to a Westchester hospital for delivery of her first child. As she progressed through labor, the doctors and nurses failed to appreciate the worrisome signs evident on the fetal monitor strips and fetal heart rate monitors. Rather than performing an emergency c-section, they allowed the labor to continue. Ultimately, the fetus suffered a loss of oxygen, and the baby was born with permanent brain damage and cerebral palsy.
