Our client, a 32-year-old delivery man for a flower shop, was assaulted on a New York City sidewalk over parking spot dispute. He was punched in the head, knocked into the roadway, and then run over by a passing City bus. The lawsuit alleged that our client was on the ground for about 20 seconds before the bus ran over his leg. The bus driver testified that he saw the assailant walk up behind our client, punch him twice, shove him into the street. He also testified that those events lasted about 30 seconds. He further testified that our client was on the ground in the street for 5-10 seconds before the bus ran him over. The driver claimed that he couldn’t turn left because there were cars in that lane. We claimed that the bus driver had enough time to see the assault occur and avoid contact with our client. As a result of the accident, our client suffered a below-the-knee amputation of his leg.
