Our client, a 46-year-old union-affiliated carpenter, was working on the renovation of a building in Westchester County. As he and a co-worker were assembling a scaffold, one of the scaffold’s platform planks collapsed, causing him to fall approximately 5-6 feet. He landed feet-first onto a cement floor. The lawsuit alleged violations of the New York State Labor Law, including Labor Law §240(1). Our client suffered comminuted fractures of each foot’s calcaneus (heel), both requiring surgery.
