Our client was a 28-year-old Hispanic male, Brooklyn resident, with no criminal history. After witnessing an accident involving a marked police car and a civilian vehicle at a Brooklyn intersection, our client remained at the scene and approached an officer to provide his version of what he witnessed. Our client believed the marked police vehicle caused the intersection accident. The police officer refused to accept his statement and he asked our client to leave the scene. When our client refused to leave, the police officer assaulted him and wrestled him to the ground, causing his head and face to strike the pavement. He was arrested for disorderly conduct, but eventually the charges were dropped. As a result of the assault, our client sustained permanent blindness in one eye. At the trial, the jury awarded our client $8.2 million dollars for his injuries.
