Our client was a 35-year-old woman at 41 weeks gestation when she arrived at a Staten Island hospital for delivery. After approximately 30 hours of active labor, the fetal monitor strips began showing signs of oxygen deprivation to the baby. Over the next 5 hours, additional worrisome signs of oxygen deprivation arose (increased fetal heart rate, abnormal fetal monitor readings). Instead of performing an emergency c-section, the doctor chose to wait and ultimately delivered the baby vaginally. Unfortunately, because the baby had been deprived of oxygen, he was born with brain damage and diagnosed with spastic quadriparesis secondary to cerebral palsy.
