A 21-year-old permanent resident of Barbados, our client experienced a sudden onset of back pain and paralysis while visiting relatives in Brooklyn. Rushed to a Brooklyn hospital, she was diagnosed with a thoracic spinal mass. However, surgery to remove the mass was not conducted promptly.
We contended that the delay in performing the surgery deprived her of the opportunity for a more favorable recovery. Defendants argued that her condition upon hospital presentation rendered any treatment ineffective in preventing permanent paraplegia.
Despite these contentions, the case was settled before trial.
