What Is the Jones Act?

The Jones Act is a federal statute that provides injured seamen the right to pursue compensation for work-related injuries and illnesses. Unlike workers’ compensation, the Jones Act requires claimants to prove that their employers (or other parties) were responsible for the incident that led to injury, illness, or death (in cases involving the wrongful death of a maritime worker).

The Jones Act Requires Maritime Employers To:

  • Provide all workers with a reasonably safe work environment to prevent maritime workers from being subjected to the risk of foreseeable injury
  • Exercise due care, based on the circumstances, to maintain the work environment and ensure it remains reasonably safe for workers

In other words, your employer has a responsibility to ensure that your workplace is reasonably safe and well-maintained. If your employer failed to do this, and you were injured as a result of an unsafe workplace or working hazard, you could have a claim under the Jones Act. This could allow you to recover monetary compensation for your medical bills, lost wages, and other injury-related losses.
