A statute of limitations is the legal deadline by which a survivor must file a lawsuit. For years, these deadlines in New York were among the most restrictive in the country, often expiring long before survivors felt ready to come forward. The CVA and ASA aim to correct this injustice.

The NY Child Victims Act (CVA)

The Child Victims Act, passed in 2019, revolutionized how child sexual abuse cases are handled in New York by extending the statute of limitations and creating a revival window for older cases.

Key Provisions of the CVA:

  • Extended Statute of Limitations:
    • Criminal Cases: Survivors of child sexual abuse can now pursue criminal charges until they turn 28 years old.
    • Civil Cases: Survivors can file civil lawsuits until they turn 55 years old, giving them more time to hold abusers and institutions accountable.
  • The Revival Window:
    • A special one-time window allowed survivors of child sexual abuse, regardless of when the abuse occurred, to file civil lawsuits.
    • Dates: The revival window ran from August 14, 2019, to August 14, 2021. This window is now closed, but the extended statute of limitations remains in place for those under 55.

The NY Adult Survivors Act (ASA)

Building on the success of the CVA, the Adult Survivors Act provides similar opportunities for survivors of adult sexual abuse to seek justice.

Key Provisions of the ASA:

  1. The Revival Window:
    • The ASA opened a one-year revival window for survivors of adult sexual abuse, allowing them to file civil lawsuits even if the statute of limitations had already expired.
    • Dates: The revival window ran from November 24, 2022, to November 23, 2023.
  2. Who Qualifies Under the ASA?
    • Survivors of sexual abuse that occurred when they were 18 years or older.
    • This applies to cases of sexual assault, rape, and other forms of abuse.

The Gender-Motivated Violence Protection Law (GMVPL) in New York City

For survivors in New York City who have experienced gender-motivated violence, the Victims of Gender-Motivated Violence Protection Law (GMVPL) offers a special provision. Under this law, survivors have a two-year look-back window to file civil claims, even if the standard statute of limitations has expired. This look-back window, aligned with the Adult Survivor Act, is set to expire on March 1, 2025. Designed specifically for cases involving gender-based violence, the GMVPL provides an additional pathway for survivors to pursue justice within New York City.
