Pedestrian Accident

A 22-year-old part-time window clerk for the United States Postal Service found herself in a disturbing situation on Linden Boulevard in Brooklyn. Chased by her boyfriend, who brandished a club, she ended up in the path of an oncoming vehicle.

According to the defendant driver, he was within the speed limit when our client “darted out” into the roadway. However, we argued that she had been in the vicinity long enough for the driver to react and prevent the collision.

The impact was severe, rendering our client unconscious and unresponsive at the scene. Her heart stopped while en route to Brookdale Hospital, but thanks to the swift action of EMS workers, her pulse was restored. Sadly, she remained in a coma until her passing three days later.

Leaving behind two young children, ages five and seven, our client’s tragic passing sparked a legal battle in Brooklyn Supreme Court. Ultimately, the jury assigned 10% responsibility to our client and held the defendant driver 90% accountable for the accident.
