In a routine maintenance task at a New York television studio, our client, a 30-year-old man, encountered an unexpected accident that resulted in serious injury.
Assigned to repair a water-damaged ceiling by applying plaster, our client utilized an “A-Frame” aluminum 8-foot ladder. However, due to the presence of a nearby generator, he was unable to fully extend the ladder and had to lean it against the wall to complete the task.
While on the ladder, a sudden shift caused our client to lose his balance. In an attempt to stabilize himself, he braced his hand against the wall, resulting in a painful sensation and a distinct “pop” in his neck.
The lawsuit filed cited a violation of Labor Law §240(1), which aims to protect workers from height-related hazards. As a consequence of the accident, our client sustained a severe neck injury that necessitated multiple surgeries, including cervical fusion.
