A statute of limitations is the legal deadline by which a survivor must file a lawsuit. For years, these deadlines in New York were among the most restrictive in the country, often expiring long before survivors felt ready to come forward. The CVA and ASA aim to correct this injustice.


The NY Child Victims Act (CVA)

The Child Victims Act, passed in 2019, revolutionized how child sexual abuse cases are handled in New York by extending the statute of limitations and creating a revival window for older cases.

Key Provisions of the CVA:

  • Extended Statute of Limitations:
    • Criminal Cases: Survivors of child sexual abuse can now pursue criminal charges until they turn 28 years old.
    • Civil Cases: Survivors can file civil lawsuits until they turn 55 years old, giving them more time to hold abusers and institutions accountable.
  • The Revival Window:
    • A special one-time window allowed survivors of child sexual abuse, regardless of when the abuse occurred, to file civil lawsuits.
    • Dates: The revival window ran from August 14, 2019, to August 14, 2021. This window is now closed, but the extended statute of limitations remains in place for those under 55.

The NY Adult Survivors Act (ASA)

Building on the success of the CVA, the Adult Survivors Act provides similar opportunities for survivors of adult sexual abuse to seek justice.

Key Provisions of the ASA:

  1. The Revival Window:
    • The ASA opened a one-year revival window for survivors of adult sexual abuse, allowing them to file civil lawsuits even if the statute of limitations had already expired.
    • Dates: The revival window ran from November 24, 2022, to November 23, 2023.
  2. Who Qualifies Under the ASA?
    • Survivors of sexual abuse that occurred when they were 18 years or older.
    • This applies to cases of sexual assault, rape, and other forms of abuse.

Gender-Motivated Violence Protection Law

Understanding the GMVA: The Victims of Gender-Motivated Violence Protection Law

The Victims of Gender-Motivated Violence Protection Law (GMVA) is a pivotal New York City law enacted in 2000 following the U.S. Supreme Court’s decision in United States v. Morrison. This decision removed critical protections under the federal Violence Against Women Act (VAWA), prompting NYC to establish its own legal framework for survivors of gender-based violence.

The GMVA empowers survivors to pursue civil lawsuits for physical or emotional harm caused by gender-motivated violence. Unlike criminal cases, which aim to penalize offenders on behalf of the state, civil lawsuits focus on holding perpetrators directly accountable to the survivor and seeking compensation for the harm caused.

What Incidents Does the GMVA Cover?

Survivors can file claims under the GMVA for incidents such as:

  • Rape or sexual assault
  • Domestic violence
  • Physical or verbal assault or battery
  • Sexual violence in the workplace
  • Human trafficking
  • False imprisonment

Claims can be made against individuals who caused the harm and/or institutions that enabled or concealed the abuse. However, to qualify, the incident must have occurred within one of New York City’s five boroughs: Manhattan, Brooklyn, Queens, The Bronx, or Staten Island.


The Lookback Window: A Limited Opportunity for Justice

In 2022, the GMVA was amended to include a special two-year “lookback window” that temporarily suspends the statute of limitations for previously time-barred claims. This window, which remains open until February 28, 2025, allows survivors to file civil claims for incidents that occurred at any point in their lives.

After the lookback window closes, individuals will have up to nine years from the date of the incident to file a claim under the GMVA.

Why Is the Lookback Window Significant?

This amendment acknowledges the unique challenges survivors face, particularly the time it may take to heal from trauma. Survivors now have the chance to seek justice for past incidents of gender-based violence, even if those incidents occurred decades ago. With the closure of the Adult Survivors Act (ASA) lookback window in November 2023, the GMVA provides the only remaining legal pathway for NYC survivors to pursue civil claims for past incidents.
