Wrongful Death

A 46-year-old married woman with two children, employed as a waitress at a restaurant in Islip, NY, faced an untimely death due to medical negligence. 

After undergoing a routine screening mammogram, which initially yielded normal results, she discovered a lump in her left breast six months later. Despite promptly reporting it to her ob-gyn and undergoing further tests, including mammograms and sonograms, the abnormalities were overlooked, and a biopsy was not performed.

Three months later, our client’s condition worsened, with her left breast becoming inflamed, swollen, and painful. A subsequent biopsy revealed late-stage breast cancer, leading to her unfortunate passing less than two years later.

During trial proceedings, our medical experts criticized the radiologists responsible for interpreting the mammograms and sonograms. They testified that the studies had indicated abnormalities warranting further investigation and biopsy. Had proper treatment been administered promptly, her cancer could have been diagnosed earlier, potentially increasing her chances of survival.

The jury concurred, finding that one of the radiologists had misinterpreted the studies and that a biopsy should have been conducted sooner. Tragically, our client passed away while the case was still ongoing.
