Our client, a 56-year-old married male and experienced union sheet metal worker, encountered an unfortunate incident while performing duties at a construction site in New York City.
Assigned to install duct work, our client utilized a 6-foot A-frame ladder to reach the desired height. Initially, he and his co-worker intended to use a lift for the task, but space constraints in the room made it impractical.
During the course of his work on the ladder, our client fell, striking his head on the ground and losing consciousness. The lawsuit filed asserted a violation of Labor Law §240(1), which aims to safeguard workers from height-related hazards.
As a consequence of the accident, our client sustained significant injuries, including a traumatic brain injury, an avulsion fracture of his thumb, a labral tear, and a rotator cuff tear. These injuries rendered him unable to resume his construction work.
