In a routine physical exam, a 46-year-old married man underwent PSA testing ordered by his internist. Despite an elevated PSA level, the internist failed to refer him to a urologist or order a follow-up PSA test for nearly two years.
When the follow-up PSA test was eventually conducted, it revealed that the cancer had spread, resulting in a late-stage prostate cancer diagnosis. Our client underwent a prostate removal surgery and was forced to undergo hormone therapy as a consequence.
The SSKB legal team clamed that if the diagnosis was made sooner, his chances of survival would have been greatly increased. The case settled before trial.
