Salenger, Sack, Kimmel & Bavaro Secures $1.1 Million Settlement in Premises Liability Case
WOODBURY, NY — Salenger, Sack, Kimmel & Bavaro, LLP secured a $1.1 million settlement on behalf of a client who was injured after tripping and falling due to a large pothole in a shopping area parking lot.
The client suffered injuries as a result of the fall. The case involved allegations that the defendant knew the pothole existed for a significant period of time but delayed making the repair due to budget concerns, allowing the dangerous condition to remain in an area used by customers and visitors.
The defense argued that the client, who was in his 60s, had several preexisting injuries. SSKB argued that the fall aggravated those conditions, made the client’s injuries significantly worse, and ultimately necessitated surgery.
The case was handled by SSKB Senior Partner Joe Bavaro and Associate Brooke McDonald, who successfully resolved the matter for $1.1 million.

We were able to show that the fall aggravated his previous conditions causing him to need surgery.”
