Our client was a union roadway foreman, working at a construction site in New York City, when a 3-foot x 3-foot piece of asphalt weighing several hundred pounds fell several feet out of the bucket of a backhoe. The asphalt was being lifted onto a truck. We claimed that the backhoe was not suitable for the work required. As a result, he sustained severe and permanent ankle and foot injuries that have left him unable to return to work.
