Our client was 40 years old and married, with a 9-year-old son. She was born in Turkey and came to U.S. when she was 9 years old. At the time of the incident, she was a successful Vice President in a large women’s clothing business earning over $200,000 per year. The incident occurred on a Saturday. Our client had recently returned from a family vacation. In the morning, she began feeling strange. At first, she thought it was indigestion. She soon developed back pain and nausea and thought she was having a heart attack. Because they lived close to a nearby hospital on Long Island, her husband drove her to the Emergency Room. She reported her symptoms and history to the security guard in the Emergency Room lobby, but then waited over 20 without any treatment from a doctor or nurse. While in the Emergency Room lobby, she suffered a massive heart attack, resulting in an anoxic brain injury and significant, permanent brain damage. The case settled after jury selection.
